Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of Douches & Poesje’s website and services (the “Site”), including purchases of pet products (such as collars, leashes, harnesses, pet-owner specialty items) offered through the Site. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or purchase anything.

 

1. Definitions

2. Eligibility

  • You must be at least 18 years old (or legal adult in your jurisdiction) to place an Order.

  • By placing an Order, you warrant that you have the legal capacity to enter into this contract.

3. How the Contract is Formed

  • All Orders are subject to acceptance by us. Once you place an Order, you will receive an Order confirmation by email. That confirmation does not mean your Order is accepted. Your acceptance happens when we dispatch the Product to you or confirm that the Product is available.

  • We reserve the right to refuse or cancel any Order for reasons including but not limited to: inability to verify payment, fraud suspicion, or Products being out of stock.

4. Product Information & Pricing

  • We aim to display Product information (descriptions, images, dimensions, materials) accurately. However, variations may occur (colours may look different depending on your monitor/screen).

  • Prices are shown in currencies South African Rand and American Dollar and include applicable Taxes (as required by law). Shipping/delivery fees may be added to the total.

  • We reserve the right to change Product prices at any time, but changes will not affect orders already accepted.

5. Payment

  • Payment must be made at the time of Order via the payment methods offered on the Site.

  • You represent that the payment details you provide are valid, correct, and that you are authorized to use them.

  • We may use third-party payment gateways; you accept that payment processing is subject to their terms as well.

6. Shipping, Delivery & Risk

  • Shipping costs, delivery times, and methods will be noted at checkout. These are estimates; delays may occur.

  • Risk of damage to or loss of the Products passes to you when we (or our carrier) deliver the Products to the address you gave us.

  • Ownership (title) of the Products passes to you once we have received full payment for the Products.

7. Returns, Refunds & Exchanges

  • If you are not satisfied with your purchase, you may return or exchange Products, subject to our Return Policy link.

  • Returns must meet certain conditions unworn less than 1 time, original packaging, tags intact, unless the Product is defective or not as advertised.

  • Timeframes: returns submitted within [14/30] days of delivery.

  • Refunds/exchanges will be processed once the returned Product is received and inspected. Shipping costs for returns may be borne by the Customer unless otherwise stated.

8. Product Use & Warranty

  • Products are meant for their intended use (pet collars, harnesses, etc.). Improper use may reduce lifespan or cause injury.

  • We do not guarantee that Products will be indestructible or suitable for all breeds, sizes, or individual animal behaviors. It’s the Customer’s responsibility to ensure correct size, fit, and safe use.

  • If a Product is defective or not as described, you may have rights under local consumer protection laws.

9. Intellectual Property

  • All content on the Site (text, images, logos, designs) is owned by or licensed to Douches & Poesje. You may not reuse, copy, modify, publish, transmit, distribute, display, or exploit in any way without our prior written permission.

10. Limitation of Liability

  • To the extent permitted by law, we will not be liable for indirect, special, incidental or consequential damages, or for loss of profits, loss of business, or loss of data, arising out of or in connection with use of our Products or Site.

  • Our total liability for any direct damages will be limited to the total amount paid by you for the Products causing the claim.

11. Indemnification

You agree to indemnify and hold harmless Douchës & Poesjë and its officers, employees, agents from and against any third-party claims, damages, losses, liabilities arising from your breach of these Terms, misuse of Products, or violation of any law.

12. User Accounts & Security

  • If you register an account on the Site, you are responsible for maintaining its confidentiality and for any activities under your account.

  • You must notify us immediately if you suspect unauthorized access or use of your account.

13. Privacy

  • Our Privacy Policy describes how we collect, use and share your personal information. By using the Site or placing an Order, you agree to that policy.

14. Changes to Terms

We may revise and update these Terms from time to time. Any changes will be posted on the Site with an updated “Last updated” date. Continued use of the Site after the posting of changes means you accept those changes.

15. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of South Africa.

  • Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity or termination, shall be subject to the exclusive jurisdiction of the courts located in Cape Town.

16. Miscellaneous

  • Force Majeure: We are not liable for failure to perform obligations under these Terms if that failure is caused by events beyond our control (e.g. natural disasters, pandemic, war, etc.).

  • Severability: If any provision of these Terms is found invalid or unenforceable, the remainder will continue in full force.

  • Entire Agreement: These Terms & Conditions, together with any policies we reference (Return Policy, Privacy Policy, Shipping Policy), constitute the entire agreement between you and us relating to the subject matter herein.
